So Who Is Really Being Sued?

One of the most misleading things surrounding personal injury is who we are actually “going after” when a lawsuit has been filed. The insurance industry has done a really great job at blaming victims and using rhetoric like, “frivolous lawsuit.” This widespread misinformation has allowed them to accomplish their mission; people usually have a negative reaction when the thought of filing a lawsuit comes into play. They don’t want to be that person.

In trial, the defense is going to do everything in their power to make it look like our client is greedy and trying to go after the sweet, innocent person for everything they own for simply making a mistake. This couldn’t be further from the truth. We are often forced to file a lawsuit because the insurance company has not acted reasonably or fairly to settle with you. They are the ones with all the power to keep their insured from being sued. But instead, they will turn the narrative around and blame you, the person whose life was permanently changed through no fault of your own.

Unfortunately, we aren’t allowed to talk about insurance when we are in trial. When a verdict is reached in favor of our client, it is not the defendant who ends up having to pay. It is the insurance. Unfortunately, the jury doesn’t get to know that.
